The Tormey Law Firm recently represented a client who contacted our firm because she feared for her safety and needed a final restraining order in Bergen County NJ.  Sadly, M.V. was being stalked by an ex-boyfriend, A.D., who, on a daily basis, would contact her cell phone, contact her place of work, and even show up sporadically at her home.  Our office immediately assisted her with filing for a temporary restraining order (TRO) and soon after, the Court scheduled a hearing to determine whether a final and permanent order of protection was going to be entered. If the FRO is entered, the defendant is prohibited from having any contact with the victim or he will be arrested. In addition, he is prohibited from her workplace, home, from owning or possessing any firearms and he is fingerprinted and placed in a database for domestic violence offenders.

In the interim, our office met with M.V. on two occasions to gather evidence and prepare her for the hearing. A.D. hired an attorney who strongly argued that he was not stalking M.V., only made a few phone calls, and her alleged fear was not credible.   Nevertheless, through proper preparation and effective cross-examination, the Court found M.V. to be very credible and moreover, rejected our adversary’s version of events.  During the Court’s ruling, the Judge stated on several occasions, I reject A.D.’s testimony and I do not give any credit to A.D.’s version of the events.  As such, the Court awarded M.V. an order of protection and also ordered that A.D. attend domestic violence counseling and pay for M.V.’s attorney fees.
