Further, the alleged victim dropped off a “gift” package at the defendant’s home just two days before filed for the restraining order. Along with the gifts was a note from her; in the note, she apologized to the defendant and told him that she loved him.

Based on Mr. Tormey’s defense, the judge dismissed the restraining order. The judge found that the alleged victim could not possibly have been afraid of the defendant, nor was it likely that she was in fear for her safety.
