Because a restraining order is a civil matter in New Jersey, you are not entitled to a lawyer. Unlike a criminal case in which you can apply for a public defender, there is no such avenue in a restraining order case. Thus, you have several options. First, you can represent yourself in court. Second, you can hire private counsel of your choosing. In terms of private counsel, attorneys can either charge you a flat rate which covers the entire matter including a trial or they can charge you an hourly rate and bill you based on the number of hours spent on the case.
NOTE: Be careful with an hourly rate agreement. These restraining order cases can sometimes entail multiple days of trial and your bill can sometimes grow to an astronomical level.
