Restraining Order Attorneys Fees in NJ

Because a restraining order is a civil matter in New Jersey, you are not entitled to a lawyer. Unlike a criminal case in which you can apply for a public defender, there is no such avenue in a restraining order case. Thus, you have several options. First, you can represent yourself in court. Second, you can hire private counsel of your choosing. Lastly, if you are the plaintiff and the victim of domestic violence, there are several free attorneys you can apply for through battered women’s groups, etc.

In terms of private counsel, attorneys can either charge you a flat rate which covers the entire matter including a trial or they can charge you an hourly rate and bill you based on the number of hours spent on the case.

NOTE: Be careful with an hourly rate agreement. These restraining order cases can sometimes entail multiple days of trial and your bill can sometimes grow to an astronomical level. For example, Mr. Tormey recently tried a restraining order case in Bergen County (Hackensack) and the trial took over a dozen trial days. Mr. Tormey charged with client a flat rate but opposing counsel was billing at an hourly rate. Opposing counsel’s bill at the end of the long trial was in excess of $35,000 and he ended up losing the case. As a result, it is typically preferable to do a flat fee in case the matter drags on like that one.
