After being retained, the domestic violence defense team at the Tormey Law Firm reviewed the case and ultimately were able to negotiate a Consent Order for Civil Restraints in which the plaintiff agreed to dismiss the temporary restraining order against the defendant. Essentially, this case was an example of two people who needed to go their separate ways, but a final restraining order was not necessary to achieve that outcome. Our client in this case was embroiled in an ongoing, contentious divorce matter in Somerset County, New Jersey. After the divorce complaint was filed, the plaintiff and defendant continued to live together and after some time, the wife obtained a temporary restraining order because she alleged that her husband was harassing her. After meeting with the client, it was apparent that the plaintiff’s case against him was not necessarily the strongest; however, our client agreed with one thing: he didn’t want to have any more contact with the plaintiff in any way, shape, or form. In other words, he wanted to move on with his life but did not want to agree to having a final restraining order entered against him because in so doing, he would have to be fingerprinted and be placed on the domestic violence registry. Thus, rather than deciding to fight the restraining order at a final restraining order trial, we opened a dialogue with the plaintiff’s attorney to see if we could negotiate a Consent Order for Civil Restraints.

As with all negotiations, both parties did not initially agree with the proposed terms, as they related to access to the marital home, division of personal property, and contact with family members and friends. However, after many phone calls and e-mails, the terms were negotiated and agreeable and both parties. Then, the parties signed the Consent Order for Civil Restraints and the court took testimony from both the plaintiff and defendant that they knowingly and voluntarily wanted to enter the civil restraints agreement. But, most importantly, the plaintiff dropped the temporary restraining order as part of the civil restraints agreement. Thus, our client did not have to be finger printed and entered on the domestic violence registry. And, ultimately, both parties got what they wanted: to peacefully move on with their lives.
