A Mount Holly, NJ woman was recently charged with murder after allegedly shooting her wife in the face. In addition to murder charges, the Burlington County Prosecutor’s Office also reported that the woman faces charges for possession of a weapon for an unlawful purpose and tampering with evidence. In this alleged domestic violence incident, the police responded to the couple’s home in Mount Holly, New Jersey after a relative reported a possible assault. Upon arrival, police officers found the victim with a gunshot wound to her face. The victim was pronounced dead at the scene of the shooting.
This possible domestic violence homicide is a tragic example of the types of situations that the New Jersey Prevention of Domestic Violence Act (“PDVA”) seeks to prevent by protecting victims of domestic violence. Under the PDVA, specifically N.J.S.A. 2C:25-19(d), a “victim of domestic violence” is defined as any person who is 18 years of age or older, or who is an emancipated minor, and who has been subjected to domestic violence by a spouse, former spouse, or any other person who is a present or former household member. “Victim of domestic violence” also includes any person, regardless of age, who has been subjected to domestic violence by a person with whom the victim has a child in common, or with whom the victim anticipates having a child in common, if one of the parties is pregnant. Additionally, “victim of domestic violence” also includes any person who has been subjected to domestic violence by a person with whom the victim has had a dating relationship.
In circumstances of domestic violence, victims can apply on an emergency basis for a temporary restraining order (TRO) to obtain protection from the perpetrator of the domestic abuse. Then, after a temporary restraining order is issued, a final restraining order (FRO) hearing will be scheduled in the Family Division of the Superior Court in the county where the temporary restraining order was entered.
