Union County NJ Restraining Order Help

Facing a Union County NJ Restraining Order? The Tormey Law Firm recently represented a client facing a final restraining order (FRO) in Elizabeth, New Jersey. The client was a college student who had no prior criminal record. He had a bad breakup with his girlfriend, which led to her filing for a temporary restraining order (TRO). Since she refused to drop the charges in court, a hearing was held to see if the permanent restraining order needed to be issued.

The girlfriend testified and said that she had been the victim of threats and assaults by the defendant. However, the couple had dated for only six (6) months, during which time the police were never called. Additionally, the girlfriend had never received any medical treatment for injuries during this time. As a result, the only proof that she had was her testimony, and no other witnesses were presented to corroborate her story. In addition, she did not provide texts, emails, voicemails, or any other proof of the alleged threats.

The Tormey Law Firm Provides a Vigorous Defense Against Restraining Order in Elizabeth, New Jersey

Mr. Tormey presented a strong defense for his client. This included testimony from the defendant, the defendant’s father, and the defendant’s ex-girlfriend, who all testified that he was never violent. In fact, the father testified that he was at the house when one of the alleged assaults occurred; he said that the alleged victim did not make any cries for help or call the police. Further, the alleged victim dropped off a “gift” package at the defendant’s home just two days before filed for the restraining order. Along with the gifts was a note from her; in the note, she apologized to the defendant and told him that she loved him.

Based on Mr. Tormey’s defense, the judge dismissed the restraining order. The judge found that the alleged victim could not possibly have been afraid of the defendant, nor was it likely that she was in fear for her safety. This was a positive outcome for the defendant and great result for the Tormey Law Firm.
