What Happens in Cases of Domestic Violence in Passaic County, New Jersey?

If you find yourself involved in a domestic violence case in Passaic County, you are not alone. Domestic violence offenses and corresponding restraining order proceedings are a regular feature of daily life in Passaic County. According to the New Jersey State Police, there were approximately 3,367 of these cases in a single year, often involving domestic violence charges for harassment, burglary, criminal mischief, assault, terroristic threats, and sexual assault. When domestic violence happens, the court may issue a temporary restraining order to protect the alleged victim of domestic violence until a final hearing can be held to determine the necessity, or lack thereof, for a final restraining order.

The final restraining order hearing must be held in a relatively short amount of time, typically within 10 days, as these matters are considered emergent in nature. The temporary restraining order requires the victim to meet a lesser burden of proof when compared with a final restraining order, as the TRO is often the interim measure pending the final outcome in the case. Unlike final restraining orders, which often involve extended hearings, trials, testimony by both parties, witnesses, cross-examinations, and other evidence, temporary restraining orders are based on the victim’s statements alone. In other words, the accused is not present at the time prior to the issuance of a TRO. The defendant is, however, entitled to hire an attorney and defend their innocence at the final hearing in Passaic County Superior Court, Family Division, in Paterson.

Ultimately, if a Final Restraining Order has been issued against you in Paterson, New Jersey, within 45 days from the entry of the Final Restraining Order, you have the option to appeal. Grounds for an appeal can include errors during trial, or related to law, facts and evidence used during trial. Whether a Final Restraining Order has been issued against you or if you are awaiting proceedings for a restraining order, The Tormey Law Firm is ready to assist you today.  We have represented countless Plaintiffs and Defendants in Restraining Orders and have zealously represented clients in appealing judicial decisions regarding Final Restraining Orders.
