A Union County man has been accused of fatally stabbing his roommate after the two argued on New Year’s Eve. According to the Union County Prosecutor’s Office, the 23-year-old suspect was arrested and charged with murder and related weapons offenses in connection with the death of his 43-year-old roommate. Reportedly, Plainfield police officers responded to the suspect and victim’s apartment at approximately 11:45 p.m. and found the victim suffering from multiple injuries. The victim was transported to a nearby hospital, where he was pronounced dead. The suspect was later taken into custody without incident after an investigation by the Union County Prosecutor’s Office Homicide Task Force.

According to New Jersey’s domestic violence laws, this case will be categorized as a domestic violence crime due to the fact that the victim and alleged perpetrator were members of the same household. N.J.S.A. 2C:25-19 (d) defines “victim of domestic violence” as any person who is 18 years of age or older or who is an emancipated minor and who has been subjected to domestic violence by a spouse, former spouse, or any other person who is a present household member or who was at any time a household member. “Victim of domestic violence” also includes any person, regardless of age, who has been subjected to domestic violence by a person with whom the victim has a child in common, or with whom the victim anticipates having a child in common, if one of the parties is pregnant. “Victim of domestic violence” also includes any person who has been subjected to domestic violence by a person with whom the victim has had a dating relationship.

The courts in New Jersey take domestic violence cases very seriously. Allegations of domestic violence can result in both criminal charges and a domestic violence restraining order. Domestic violence crimes or offenses will be handled in either the Criminal Division of the Superior Court or Municipal Court, depending on the nature of the offense, while any case regarding a restraining order will take place in the Family Division of the Superior Court. In other words: allegations of domestic violence can lead to a complex, dual-tracked case that requires detailed attention, comprehensive strategy, and zealous advocacy.
